Wrongful Death

When negligence takes a life — on the road, in a hospital, on someone's property, or in a fire or explosion — the law allows surviving family members to claim for their losses. Under Ontario's Family Law Act, eligible family members can recover both financial losses and the loss of the care, guidance and companionship the person provided.

Who can bring a wrongful-death claim in Ontario?

Generally a spouse, children, grandchildren, parents, grandparents and siblings of the person who died may claim under the Family Law Act. The estate may also have its own claim. Step-siblings and common-law spouses can sometimes make claims depending on proximity to the lost loved one.
